The government has promulgated Law 27,436, which criminalises the possession of child pornography with jail terms of up to six years in prison.
The law, which passed Congress in March, punishes those who produce, finance, trade, publish or facilitate by any means the spread of child pornography with penalties of between three and up to six years in prison.
The law was published on Tuesday in the Official Gazette, signed by President Mauricio Macri, Cabinet Chief Marcos Peña and Justice Minister Germán Garavano.
Its text, modifying Article 128 of the Criminal Code, defines child pornography as "any such representation of a minor of 18 years dedicated to explicit sexual activities or any representation of their genital parts for predominantly sexual purposes."
The law also says that those who provide access to pornographic shows or provide pornographic material to children under 14 years old will be punished with up to three years in jail.
The penalties will be a third harder in the case that the victim is under 13 years.
Until now, the law only punished the production and commercialisation of these types of images with imprisonment.
