Federal prosecutor Ramiro González on Tuesday formally indicted ex-president Alberto Fernández and other former officials on charges of fraud in insurance contracts awarded by the ANSES social security administration.
The case is running parallel to a lawsuit already lodged by lawyer Silvina Martínez and others, but this time the plaintiff was Human Capital Minister Sandra Pettovello.
The case revolves not so much around the ANSES insurance policies themselves – compulsorily contracted for all state agencies via Nación Seguros according to decree 823/2021 signed by then President Fernández – as around the payment of “undue” commissions.
Former Nación Seguros CEO Alberto Pagliolo, the former director of the FGS (Fondo de Garantía de Sustentabilidad) ANSES reserve fund Federico D’Angelo Campos and allied brokers have all been indicted.
The manoeuvre consisted of extending loans to pensioners which were unpayable for one reason or another, including death, and then collecting on the insurance to the tune of 10 billion pesos.
González suggested to federal judge Julián Ercolini, who is in charge of the case, to ask the Auditor-General’s office to report on the facts in order to obtain solid evidence with special emphasis on the insurance companies San Ignacio Sociedad de Productores Asesores de Seguros S.A and TG Broker S.A.
Ercolini ordered 27 court raids on a score of companies in order to pick up documentation in connection with this case last Monday.
Prosecutor González requested a “special experts report with the aim of determining the damage done to assets” by the 2021 decree signed by then-president Fernández.
Among the witnesses to be summoned is Osvaldo Giordano, the ex-ANSES chief fired by President Milei.
Prior to those indicted on Tuesday, Héctor Martínez Sosa and Pablo Torres García had already been indicted in the previous investigation pressed by Silvina Martínez.
Since the two investigations centre on similar facts, they may finally be rolled up into one.
